4. State-by-State Regulations
Each state has specific EPA regulations that modify or extend the national baseline. This section details critical operational differences for each jurisdiction.
🔵 NEW SOUTH WALES (NSW)
Highest operational complexity + strictest waste classification system
Legislative Framework:
- Protection of the Environment Operations Act 1997 (POEO Act)
- Protection of the Environment Operations (Waste) Regulation 2014
- NSW Waste Classification Guidelines (core document)
- Asbestos Guidelines (Safework + EPA)
- Resource Recovery Orders & Exemptions
🚨 GHW Rules (Strictest in Australia)
NSW has zero tolerance for ANY bricks, concrete, tiles, soil, sand, or rubble in General Waste. ANY construction waste is prohibited. GHW → LM/MH reclassification occurs extremely easily due to strict landfill controls.
Asbestos Rules (Critical): Must be double-wrapped in 200μm plastic, labelled, transported under Specific Resource Recovery Order, recorded in NSW EPA tracking system (WasteLocate). NO asbestos in any standard bin – automatic rejected load.
E-waste Rules: Unlike VIC, NSW allows small household electronics if accepted by provider. NOT allowed: TVs, screens, computer monitors, large appliances.
Enforcement & Penalties: $7,500–$15,000 on-the-spot fines, up to $5M for corporations, up to 2 years imprisonment for individuals.
🟣 VICTORIA (VIC)
E-waste ban + strict tracking
Legislative Framework:
- Environment Protection Act 2017
- Environment Protection Regulations 2021
- E-waste (Waste Management Policy) 2019
- Industrial Waste Resource Guidelines (IWRG)
🚨 E-WASTE BAN (Most Strict Rule in Australia)
ALL e-waste banned from ALL skip bin types. Any item with a plug, cord, or battery may NOT be sent to landfill.
Prohibited: TVs, computers, phones, laptops, microwaves, small appliances, power tools, and anything with electronic components.
Operational Notes: E-waste is the #1 risk of contamination in VIC. MH/BC classification more flexible than NSW. Landfills are strict on ENM/VENM classification.
🟡 QUEENSLAND (QLD)
Regulated waste tracking system
Legislative Framework:
- Environmental Protection Act 1994
- Environmental Protection Regulation 2019
- QLD Regulated Waste Tracking System
Regulated Waste (QLD-Specific): Includes asbestos, tyres, batteries, waste oils, contaminated soil, many chemicals. Any regulated waste is prohibited from standard bins.
Asbestos Rules: If asbestos >175kg → environmental authority required. Tracking mandatory for all asbestos.
🟠 WESTERN AUSTRALIA (WA)
Extremely strict GHW restrictions
⚠️ Key WA Distinction (Critical)
WA GHW is the strictest in Australia: No bricks, concrete, tiles, soil, sand, rubble, metals, or heavy waste allowed under any circumstances. WA landfill operators are extremely strict about mixed loads.
🔴 SOUTH AUSTRALIA (SA)
Strict contamination enforcement
Similar to national baseline but with strict contamination enforcement. Big on illegal dumping enforcement. Wrong materials can result in extra disposal charges.
🟢 TASMANIA (TAS)
Waste levy framework
WARR Act + levy system. Soil must be tested for contamination. With levies expanding, mixed loads get more expensive – push customers towards correct bin type up-front.
⚫ NORTHERN TERRITORY (NT)
Listed waste framework
Listed waste includes: asbestos, oils, chemicals, contaminated soil. Never allowed in standard bins. Be especially cautious around borderline materials.
🔵 AUSTRALIAN CAPITAL TERRITORY (ACT)
Strict asbestos regulations
🚨 Asbestos Rules (Among Strictest)
No ACM of any type allowed in standard bins. Requires licensed asbestos removalist. Any suspected asbestos must be immediately quarantined and professionally assessed.
5. Customer-Friendly Quick Guide
How to Pick the Right Bin
| Your Project | Choose This Bin | Why? |
|---|---|---|
| House clean-up | General Waste (GHW) | Light household items only |
| Garden cleanup | Green Waste (GW) | Vegetation and organic matter |
| Small renovation | Light Mixed (LM) | Plasterboard, timber, light materials |
| Big renovation with heavy materials | Mixed Heavy (MH) | Heavy materials, bricks, concrete, soil |
| Only bricks/concrete | Bricks & Concrete (BC) | Pure hardfill materials only |
| Only soil/dirt | Soil & Dirt (SD) | Natural earth materials |
💡 Pro Tip: When in doubt, choose Mixed Heavy (MH) – it’s the most flexible and avoids most contamination charges. It can accept everything Light Mixed can, plus heavy materials.
Smart Tips to Avoid Extra Fees
- Keep waste types separated – A general waste bin becomes heavy as soon as bricks or soil appear.
- Don’t mix soil into any bin except Soil/Mixed Heavy – One shovel of soil can reclassify an entire GHW or LM bin.
- Don’t hide things – All loads get tipped and inspected at the facility.
- When in doubt → choose Mixed Heavy – It’s the most flexible and avoids 90% of contamination charges.
- Take photos before pickup – If a load is reclassified, you have proof of what you put in.
State-by-State Customer Notes
- NSW (Strictest): No bricks/tiles/soil in General Waste. Skip loads checked heavily. Asbestos strongly policed.
- VIC (E-Waste Ban): No TVs, electronics, appliances. No cords, plugs or batteries.
- QLD: No asbestos, chemicals, or liquids. Soil rules stricter in some regions.
- WA (Very strict GHW): General Waste = light waste ONLY. No heavy items at all.
- SA: Similar to national. Heavy waste must go in Mixed Heavy.
- TAS: Soil must be clean. Landfill levy encourages proper sorting.
- NT: No hazardous materials. Heavy waste allowed only in MH.
- ACT (Strict asbestos rules): No ACM in any bin. Choose MH for renovations.
6. Provider Operational Procedures (SOPs)
Standard Operating Procedures for all HireSkip Solutions providers and subcontractors. These SOPs apply nationally to ensure EPA compliance, customer fairness, operational safety, and accurate billing.
